How Ad Vital collects, uses, and protects information across our website and Services.

1. Overview

This policy explains how Ad Vital collects, uses, and protects information when you use our website and Services. We act as a service provider to aesthetic practices and, where we handle protected health information (PHI), as a HIPAA business associate under a Business Associate Agreement. Texts sent by Ad Vital to its own prospective or existing business customers are distinct from texts a practice sends to its patients through Ad Vital; the practice is responsible for its own patient-facing notices and consents.

2. Information we collect

We collect account and practice details you provide, communications handled through the Services (calls, texts, emails, and social messages), scheduling and payment data, and technical information such as device and usage logs. For Ad Vital's own SMS program, this may include your mobile number, the content of messages, and records of consent, delivery, and opt-out. Patient information is processed on behalf of, and under the instruction of, the practice.

3. How we use information

We use information to operate and improve the Services, answer and route communications, book appointments, process deposits, generate reporting, and provide support. For people who have opted in to Ad Vital's own SMS program, we use mobile information to send demo booking confirmations, reminders, scheduling and rescheduling updates, responses to inquiries, customer support, service-related updates, and follow-up about the Ad Vital products or services they requested information about. We do not sell personal information.

4. Call and message recording

The Services may record and transcribe calls and messages to provide context, quality, and follow-up. Practices are responsible for providing any notices and obtaining any consents required by applicable law in their jurisdiction.

5. Protected health information

Where we process PHI, we do so only as permitted by the applicable BAA and HIPAA. The BAA governs our obligations with respect to the use, disclosure, and safeguarding of PHI.

6. Sharing and subprocessors

We share information with trusted subprocessors (such as communications carriers, payment processors, and cloud infrastructure providers) only as needed to deliver the Services, under appropriate contractual protections. We may disclose information when required by law. The specific restrictions on mobile information and SMS consent below apply to all of these categories.

7. SMS consent and mobile information

We do not sell, rent, or share your mobile number, SMS opt-in information, or SMS consent status with third parties or affiliates for promotional or marketing purposes, lead generation, or third-party analytics. We will not share your opt-in to an SMS campaign with any third party for purposes unrelated to providing the services of that campaign. We may share the minimum necessary mobile information and SMS consent status with vendors that help provide our messaging services, including messaging platforms and phone carriers, solely to deliver and manage those messages, or when required by law. These restrictions apply regardless of any other data-sharing description in this policy.

You may withdraw SMS consent at any time by replying STOP to the Ad Vital number that texted you. Reply HELP to that number for assistance, or contact support@advital.app or (832) 835-5730. Withdrawing consent stops the applicable Ad Vital SMS program, but does not prevent us from responding to another request you initiate through a different channel. See our Terms & Conditions for the SMS program terms.

8. Security

We use administrative, technical, and physical safeguards designed to protect information. No system is perfectly secure, but we work to protect your data and to notify affected parties of incidents as required.

9. Retention and your choices

We retain information for as long as needed to provide the Services and meet legal obligations, including records of SMS consent and opt-out as needed to honor your choices and demonstrate compliance. Practices may request export or deletion of their data subject to the order terms and applicable law. Individuals should direct requests about their PHI to the treating practice.

10. Cookies

Our website uses cookies and similar technologies for functionality and analytics. You can control cookies through your browser settings. SMS opt-in information and consent status are not provided to third parties for advertising analytics.

11. Changes and contact

We may update this policy from time to time; material changes will be communicated. Questions? Email support@advital.app or call (832) 835-5730.
